We guarantee the timely arrival of
your gifts in perfect condition. If you or your recipient
are not 100% satisfied, simply return
the item for replacement or a prompt refund. Contact
USA Basket Gifts within 3 business days of receipt of
order for guarantee.
We are not responsible for gift delivery
if there is no response to our email sent out to verify
your order. At our discretion we will ask for a response
to our order confirmation email. All orders will not
be placed until an order confirmation is sent by USA
Basket Gifts. You will receive an email with the details
of your order. If there are no corrections to this email,
we will proceed with your order. We are not responsible
for incorrect addresses or delays with wine shipments,
due to recipients signature required. We are not responsible
for order delays, lost orders or unconfirmed orders
placed on our website, phone or mail. Orders must have
a confirmation email by USA Basket Gifts
All out of stock items will have
suggested replacements by our gift basket coordinators.
All substitutions are of the same or of greater value.
Most of our item have a similar item available.
Upon receipt of your order, if the original selected
item is not available, the suggested similar item will
replace that item. In the event neither the suggested
replacement or your selected gift is not available,
we will send you and email requesting a replacement
from you. All wine basket orders that do not meet
our wine delivery schedule (states available to ship
wine products to) will be substituted for a basket of
equal or greater value that does not contain wine.
We do not sell wine products to anyone
under the age of 21. By ordering our wine products
you are stating that you are 21 years of age or older
and that you are sending this gift to person/persons
that are also 21 years of age or older. USA Basket
Gifts assumes no responsibility for any actions and/or
redirection of original gift recipient, before, during
or after consumption of this wine product.
During the summer months USA Basket
Gifts does not ship chocolates. we will email
you after an order is placed and suggest a substitution
of equal or greater value. Because everyone does
not check their emails regularly, if a response is not
made by, on your acceptance of a substitution, we will
automatically substitute your item for one of equal
or greater value, to ensure receipt of your thoughtfulness
of your gift.
We reserve the rights to raise our prices accordingly to our
industry. Our copyright is defined as the structure
and layout of this website. Our copyright does not include
gift basket, gift towers, wine and cheese, cookie/chocolate,
or gourmet food product descriptions, name brands and
or some product images. These copyrights and trademarks
are reserved by the original manufacture/supplier of
each that particular item. We do not imply or suggest
that we are distributors and/or suppliers for any of
our name brand gourmet or chocolate products. We use
many name brand products in our gift baskets, including
Ghirardelli and Godiva Chocolates, Cru De Provence spa
items and a variety of wines and cheeses, to name a
few.
Under no circumstances shall
USA Basket Gifts or any other party
involved in creating, producing, or distributing
USA Basket Gifts products be liable
for any direct, indirect, incidental, special, or consequential
damages that result from the use of or inability to
use USA Basket Gifts, including but
not limited to reliance by a User on any information
obtained from USA Basket Gifts or that
result from mistakes, omissions, interruptions, deletion
of files or email, errors, defects, viruses, delays
in operation or transmission, or any failure of performance,
whether or not resulting from acts of God, communications
failure, theft, destruction, or unauthorized access
to USA Basket Gifts's records, programs,
or services. User hereby acknowledges that this paragraph
shall apply to all content, merchandise, and services
available through USA Basket Gifts.
